Corona Alert: West Bengal government Invokes ‘Epidemic Diseases Act 1897’ as a precaution measure to combat Corona Virus infection outbreak.

In order to combat Corono virus infection, the Government of West Bengal has implemented the Epidemic Diseases Act in the state. The act empowers the state government to work effectively preventing Corona infection and taking strict action against those who break the law.

Kolkata: The state government was alarmed after the case of corona infection suspect attempted to escape from the quarantine and hospital. After which the state government implemented the Epidemic Diseases Act 1897 in West Bengal. State Chief Minister Mamata Banerjee announced after the high-level meeting held in the state secretariat on Monday that the epidemic act was being implemented in the state.

According to the sources, the act has been implemented in the state after a woman suspected of corona infection attempted to flee from Beliaghata ID Hospital. Also in the North 24 Parganas district, the case of few Corono Infection suspects misbehaved with the district administration and doctors. After the enactment of the Act, the state government can take strict action against those who break the law.
A few days ago in Uttar Pradesh, an FIR was lodged under this Act against railway official for hiding information about his daughter who was a Corona infection suspect.

The law gives special powers to the center and the state

The law provides additional powers to the central and state government to prevent the spread of an epidemic. States have started implementing this law on the instructions from the central government. According to the law, there is a provision for the arrest and punishment for non-compliance of government orders.

Law was made to control the Mumbai plague

The law was first created to deal with the plague epidemic in Mumbai. This law is used when it seems that the common law is not sufficient to prevent an epidemic.

Investigation and Right to Isolate

The law has a provision through which the government may investigate passengers traveling by railway or any other means of transport. The law also provides the power to isolate or even hospitalize the suspect/s of an infection. This law gives the right to take into custody any person who is suspected of being an infection carrier, in view of the possibility of infection spreading.
